Binding Terms
By using or purchasing any goods or services provided by Sahara Compute LLC, you expressly agree to all terms within this agreement.
Terms are subject to review and change without client consent, with notifications via site-wide announcements.
These terms remain binding until all contracts and services between Sahara Compute and you are completed.
General Provisions
All legal matters fall under the jurisdiction of Florida, United States of America.
If any provision is declared illegal or void, the remainder of the agreement continues in full force.
Fair Use
'Unlimited' or 'unmetered' resources are subject to fair use policies.
Users should not exceed 5-10% of overall system capacity.
Services causing disruption may be terminated without notice.
Sahara Compute LLC reserves the right to terminate services that violate fair use policies.
Refunds
Refunds are evaluated on a case-by-case basis.
Account deposits are non-refundable.
Technical issues must be reported within 24 hours for potential refunds.
Colocation, Dedicated, Domain Services, Setup Fees and product addons are non-refundable.
Content License
You grant Sahara Compute LLC an exclusive license to use your content.
You must own or have permission to use all content.
You must have the right to grant Sahara Compute LLC a license to host the content.
Liability
You agree to indemnify and hold Sahara Compute LLC harmless from any claims or damages.
Exceptions must be expressly agreed to in writing by Sahara Compute LLC's legal and executive teams.
Service Termination
Services may be permanently removed after 5 days of non-payment.
Sahara Compute LLC reserves the right to terminate services for abuse without notice.
Data may be retained for up to 365 days depending on termination cause.
Data may be forwarded to relevant Law Enforcement Agencies if needed.
Payments
All payments must be made in advance.
Invoices are generated 7 days before the billing date.
Payments are processed through Stripe payment gateway.
Credit cards may be subject to additional transaction fees.
Chargebacks
Chargebacks are strictly prohibited and will result in service termination.
Service restoration requires payment of chargeback amount plus gateway fees.
Chargebacks may be reported to Major Credit Bureaus.
Fraud checking services may be notified of chargeback activity.
Dispute Resolution
All disputes must be settled through ICC Arbitration.
Arbitration location will be determined by Sahara Compute LLC.
Out-of-court resolution must be attempted before litigation.
Customers must attempt amicable resolution before pursuing arbitration.
